Acceptance of Terms
The TOS is a legally binding agreement that shall govern the relationship with the users and other legal entities which may interact, engage or interface with Starheal, LLC ("Starheal" or "we"), in association with the use of the website https://www.starheal.com (the "Site") that is owned, operated, or managed (as applicable) by Starheal along with related Services, as detailed below.
Description of Services
Starheal provides astrology readings, consultations, and related services that are designed for personal reflection, guidance, and entertainment. These Terms govern the general use of our Site and aforementioned services ("Services"). While the insights gained from astrology readings can be profound, they are not to be construed as professional advice in areas such as legal, medical, financial, psychological, or relationship counseling. Users are advised to seek professional guidance from qualified individuals for such matters. Starheal provides no guarantees regarding the accuracy, reliability, or completeness of astrological predictions or guidance.
All visitors to our Site, whether they are registered or not, shall be deemed "users" of the Site. Once an individual registers for our Services, the user shall then be considered a "member."
The user and/or member acknowledges that the Services are the sole property of Starheal. Starheal reserves the right and discretion to offer additional Services and/or products, or update, modify, or revise any current content. Your continued use of the Site and/or Services after such posting of any updates, changes, and/or modifications shall constitute your acceptance of those changes.
The Services offered are provided "AS IS" and Starheal does not assume responsibility or obligation for the timeliness, missed delivery, deletion, and/or any failure to store user content, communication, or personalization settings.
Eligibility and Registration
To register and become a "member" of the Site, you must be at least eighteen (18) years of age or the legal age as per your applicable jurisdiction, to enter into and form a legally binding contract. In addition, you must be in good standing and not an individual that has been previously barred from receiving Starheal's Services under the laws and statutes of the United States or other applicable jurisdiction.
To access some features of the Services, you will be required to register for an account. When registering, you agree to provide true, accurate, current, and complete information. You also agree not to impersonate anyone, misrepresent any affiliation, use false information, or otherwise conceal your identity from Starheal for any purpose.
If a member or user provides any information of a false, untrue, inaccurate, or incomplete nature, Starheal reserves the right to suspend or terminate the member and refuse any current or future use of the Site and/or Services.
Service Ordering & Payment
Once you are a member you can order Services through our Site or by contacting us directly via phone or email. By purchasing any of the Services, you agree to pay the fees as stated on the Site at the time of purchase. All payments are due in full upon booking unless otherwise stated. Starheal reserves the right to modify pricing or cancel Services at any time. All payments are processed through secure third-party payment processors. Starheal does not store your payment information. Refunds are not guaranteed and will be issued solely at Starheal's discretion. Once a reading or consultation has been provided, refunds will not be given.
Privacy Policy
Every user or member's registration data and various other personal information are strictly protected by Starheal in accordance with the Online Privacy Policy accessible via the Site. As a user and/or member, you consent to the collection and use of the information provided, including the transfer of information within the United States and/or other countries for storage, processing, or use by Starheal. Starheal handles sensitive information in compliance with applicable laws.
Third Party Services
Advice from Third Parties. Some of the Services involve advice from third parties and third-party content. You agree that any such advice and content is provided for information, education, and entertainment purposes only, and does not constitute legal, financial, medical, or other advice from Starheal. You agree that Starheal is not liable for any advice provided by third parties, and is not responsible or liable for any decisions or actions you take based on information you receive as a user or member of Starheal.
Sharing Information with Third Parties. By using the Services, you agree that Starheal may collect, store, and transfer information on your behalf and at your request. You agree that your decision to share sensitive or confidential information to third parties while using the Site and/or Services is your sole responsibility and at your sole risk.
Starheal Does Not Endorse Third Parties. The Services may contain links to third-party websites and services. Starheal provides such links as a convenience and does not control or endorse these websites and services. You acknowledge that Starheal is not responsible for the legality, accuracy, or appropriateness of any third-party content.
Account, Password and Security
You are solely responsible for maintaining the confidentiality and security of your password and other Registration Information. For your protection and the protection of other users, you must not share your Registration Information with anyone else. Starheal shall not be liable for any actions or omissions due to breach by you of this responsibility. If you have reason to believe that your account is no longer secure, you must immediately notify us by email.
Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose, or in violation of any local, state, national, or international law;
- Violate or encourage others to violate the rights of third parties, including intellectual property rights;
- Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate;
- Interfere in any way with security-related features of the Services;
- Disseminate viruses, adware, spyware, worms, or other malicious code, make unsolicited offers, or attempt to collect personal information about other individuals without their consent;
- Access, monitor, or copy any content using any robot, spider, scraper, or other automated means without Starheal's express written permission;
- Perform any fraudulent activity, including impersonating any person or entity, claiming false affiliations, or accessing the accounts of other users without permission;
- Sell or otherwise transfer the access granted herein.
Starheal reserves the right to pre-screen, refuse, and/or delete any content available through our Site or Services. We also reserve the right to access, preserve, and/or disclose member account information if required to do so by law or in good faith.
User Contributions
Starheal shall not lay claim to ownership of any content submitted by any visitor, member, or user. You hereby grant Starheal worldwide, royalty-free, irrevocable, and non-exclusive licenses for use in accordance with the conditions of these Terms. You acknowledge that your contributions do not contain confidential or proprietary information, and that Starheal shall not be liable or under any obligation to ensure or maintain confidentiality related to any contributions.
Indemnity
You agree to defend, indemnify, and hold harmless Starheal from and against any claims, liabilities, damages, losses, and expenses (including attorneys' and accounting fees) arising out of or in any way connected with (i) your access to, use of, or alleged use of the Site and Services; (ii) your violation of these Terms or any applicable law or regulation; (iii) your violation of any third-party right, including intellectual property, publicity, confidentiality, property, or privacy rights; or (iv) any disputes or issues between you and any third party.
Commercial Reuse
You agree not to replicate, duplicate, copy, trade, sell, resell, or exploit for any reason any part, use of, or access to Starheal's Sites and/or Services.
Modifications & Termination
Starheal reserves the right to modify, alter, and/or discontinue, whether temporarily or permanently, the Site, Services, or any part thereof, with or without prior notice. Starheal may, without prior written notice, immediately suspend, terminate, discontinue, and/or limit your account for breach or violation of these Terms, requests from law enforcement, technical or security issues, extended periods of inactivity, fraudulent activities, or nonpayment of fees.
As a member, you may cancel or terminate your account, associated email address, and/or access to our Services by submitting a cancellation or termination request.
Warranty Disclaimers
The Services are provided "as is" and on an "as available" basis, without warranty or condition of any kind, either express or implied. Starheal does not guarantee the accuracy of, and disclaims all liability for, any errors or other inaccuracies in the information, content, recommendations, and materials made available through the Services.
Astrology is a field that involves interpretation and is subjective in nature. While Starheal and Amy Tripp strive to offer accurate and insightful readings, results may vary from individual to individual. Starheal does not warrant or guarantee that the Services will meet your expectations or result in specific outcomes. The information provided in astrology readings is intended solely for general information and educational purposes. It is not intended as a substitute for professional advice or judgment.
Limitation of Liability
In no event will Starheal be liable to you for any incidental, special, consequential, direct, indirect, or punitive damages, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Starheal has been informed of the possibility of such damage. Some jurisdictions do not allow the disclaimer of warranties or limitation of liability in certain circumstances, so some of the above limitations may not apply to you.
Intellectual Property
You acknowledge and agree that Starheal's Site and Services, and any essential software used in connection with them ("Software"), contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws. All content provided through our Site and Services, including text, graphics, images, software, and logos, is owned by or licensed to Starheal. You are granted a limited, non-exclusive, and non-transferable license to use the Services for lawful purposes in accordance with these Terms.
Governing Law & Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Starheal is headquartered, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by a recognized arbitration body. The seat, or legal place, of arbitration shall be in the state where Starheal LLC is registered. The language of the arbitration shall be English.
Class Action Waiver. You agree that any arbitration or proceeding under these Terms shall be conducted on an individual basis and that you shall not participate in any class action, class-wide arbitration, or claims brought in a representative capacity.
Force Majeure
Starheal shall not be liable for any delay or failure to perform any obligation under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, natural disasters, or interruptions in internet or telecommunications services.
DMCA
If you believe that any content on our Site or Services infringes upon your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by emailing our Copyright Agent with the required information.
General Provisions
Entire Agreement. These Terms constitute the entire agreement between you and Starheal regarding the use of the Site and Services.
Waiver and Severability. Failure by Starheal to exercise or enforce any right or provision shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the remaining provisions shall remain in full force and effect.
Assignment. You may not assign your rights or delegate your obligations under these Terms without prior written consent of Starheal. Starheal may assign its rights and obligations without restriction.
No Partnership or Agency. Nothing in these Terms shall be construed as creating a partnership, joint venture, or agency relationship between you and Starheal.
Survival. Provisions that by their nature should survive termination — including those regarding intellectual property, warranty disclaimers, limitation of liability, indemnification, and governing law — shall survive.
Language. These Terms are written in English. Any translated version is provided for your convenience only, and the English version shall prevail in the event of any conflict.
